These GHIN Trial Terms and Conditions (“Terms”) govern your access to and use of the GHIN Trial services made available through the GHIN App or GHIN website, provided by the United States Golf Association (“USGA”). The GHIN Privacy Policy and the GHIN Terms of Service which are incorporated into and forms a part of these Terms.
Please read these Terms carefully before accessing or using the GHIN Trial. By accessing or using any part of the GHIN Trial, you agree to become bound by all the terms and conditions of this agreement. If you do not agree to all the terms and conditions of this agreement, then you may not access or use the Services. “You”, “User” or “Authorized User” shall mean the individual who has registered to use the GHIN Trial.
Definitions
“GHIN Account” refers to an Authorized User’s account made available through the GHIN App or GHIN website providing access to the GHIN Services. Upon registering for the GHIN Trial, a User establishes a GHIN Account and receives a GHIN Trial Number.
“GHIN Services” refers to the full GHIN suite of products and services available to Users, including all available functions and features, upon establishing a Handicap Index® and registration of a GHIN Account.
"GHIN Trial" refers to the free trial products and services of GHIN offered by the USGA allowing Authorized Users to access certain limited features of the full GHIN Services.
“Estimated Handicap Range” refers to the estimated range of the User’s Handicap Index, provided after User’s posting a total of fifty-four (54) holes.
“Services” includes all services provided in the GHIN Trial and all services provided by GHIN.
“User” refers to an individual utilizing the GHIN Trial free trial service.
“User Content” means any content that users (including you) provide to be made available through the GHIN Trial.
“Term” means the period of time when the GHIN Trial is available for use. The Term commences when an Authorized User registers for a GHIN Trial, creating a GHIN Account, and will expire thirty (30) days upon User’s receipt of an Estimated Handicap Range.
GHIN Trial Terms
A. GHIN Trial is a free trial allowing Authorized Users to create a GHIN Account and use limited features of the GHIN Services. GHIN Trial Users will be able to use the following GHIN Trial features:
Posting golf scores including total, hole-by-hole, stats, and round summary
Estimated Handicap Range (available only after posting your 54th hole score)
Apple Watch integration for score and stat tracking (Only available for iOS devices)
Starting Round: hole-by-hole, hole-by-hole with stats, and keep score for group Match Play (Gross)
Stats: score history and stats
Accessing My Profile and GHIN Trial Number
B. The following GHIN Service features are not included with the GHIN Trial:
Golfer Lookup
Handicap Calculator
Handicap History
My Card
Display Handicap Index/Low H.I.
Display of Course Rating/Slope Rating
Display of Score Differentials
Match Play (Net)
Basic GPS
Enhanced GPS
Green/Putt Maps
C. The Term of the GHIN Trial commences when an Authorized User registers for a GHIN Trial thereby establishing a limited GHIN Account. The Term will expire thirty (30) days after receipt of an Estimated Handicap Range.
D. Upon expiration of the GHIN Trial, Users may access only limited features of the GHIN Services within their GHIN Account, including Score History, Stats, GHIN Trial Number. All other features will be unavailable until the User establishes a Handicap Index through an association membership.
E. In order to access all GHIN features, Users must register for a Handicap Index through an golf association membership that issues a Handicap Index (virtual or green grass).
Account Registration
A. GHIN Trial requires Authorized Users to register and create a GHIN account. When registering, you agree to (a) provide accurate, current and complete account information, (b) maintain and promptly update your account information, (c) maintain the security of your account credentials, including passwords, and (d) promptly notify the USGA if you discover or suspect any unauthorized access or use of your account.
B. GHIN Trial is available to Users who have not previously been issued a Handicap ID. If User’s e-mail address is already associated with a Handicap ID, it is ineligible for the trial. USGA will verify through the User’s email address if User was previously issued a Handicap ID.
C. Users must be residents of the United States or Puerto Rico and 13 years of age or older to participate in the GHIN Trial and create a GHIN Account. By accessing or using the GHIN Trial, you represent and warrant that you are at least 13 years of age.
User License and Terms
A. Subject to your compliance with these Terms and solely for so long as you are permitted by the USGA to access and use GHIN Trial, the USGA grants you a limited, non-transferable, non-exclusive, revocable right and license to access and use GHIN Trial and your GHIN Account for your own personal, non-commercial purposes, a right which may not be assigned or sublicensed to anyone. All rights, title and ownership of the GHIN Trial and GHIN Services remain with the USGA or its licensors, as applicable. The rights to download and use the GHIN Trial and GHIN Services are licensed to you and are not being sold to you.
B. This license grant is subject to you agreeing to and abiding by the GHIN Privacy Policy and the GHIN Terms of Service Agreement which are incorporated into and forms a part of these Terms. For clarity, Sections 5-18 of the GHIN Terms of Services Agreement shall apply to Users and use of the GHIN Trial.
C. This license will remain in effect unless and until User violates these Terms or this license is terminated by you or the USGA.
Severability
In the event any provision of these Terms or the application of any such provision to either USGA or User shall be held by a court of competent jurisdiction to be contrary to any state or federal law, or otherwise unenforceable, the remaining provisions of these Terms shall remain in full force and effect.
Force Majeure
We will not be liable to you for any lack of performance, or the unavailability or failure, of the GHIN Trial, or for any failure or delay by us to comply with these Terms, where such lack, unavailability or failure arises from any cause beyond our reasonable control.
Termination & Account Deletion
The USGA may, in its sole discretion, suspend, disable, or delete your GHIN Trial and/or access to your GHIN Account (or any part thereof) or block or remove any User Content that you submitted, for any reason with or without notice, including if the USGA determines that you have violated these Terms or that your conduct or User Content would damage the USGA’s reputation or goodwill. Upon termination all licenses granted by the USGA and GHIN Trial will terminate.
Modifications
We reserve the right, at our sole discretion, to modify, add, delete or impose new conditions to these Terms at any time. In addition, the USGA reserves the right suspend, terminate, or cease the GHIN Trial in its sole discretion, with or without notice. Changes shall be effective immediately upon notice, which be provided by any reasonable means including, but not limited to, posting within the GHIN Services, email, updating these Terms with a new effective date. Any use of GHIN Trial after such notice is provided shall be deemed acceptance by the Authorized User of such changes.
